Baylor football player charged with sex assault

Tevin Elliott was suspended from the Baylor football program Friday, with staff citing an unspecified violation of team policy.

Suspended Baylor University defensive end Tevin Elliott was arrested Monday on charges that he sexually assaulted a woman April 15 at a party at a South Third Street apartment complex.

Elliott, 20, is suspected of sexually assaulting a woman twice at the Aspen Heights apartments, 3344 S. Third St., according to a search warrant affidavit to obtain a DNA sample from him last week.

Baylor coach Art Briles suspended Elliott indefinitely from the football program Friday, citing an unspecified violation of team policy.

Briles declined comment Monday on Elliott’s arrest.

The alleged victim told police she met Elliott at the party and knew him only as “Tevin.” She said Elliott took her by the hand and led her to the back door of the apartment. She told him she needed to get a ride home with her friend, but Elliott said it was OK, according to records filed in the case.

The woman told Waco police investigators she went with Elliott because there were people outside. She reported that Elliott picked her up and took her to the pool and volleyball court, “where she was sexually assaulted twice,” the affidavit alleges. She told police she said no to Elliott on several occasions.

The woman said she returned to the party, where she told her friend what had happened. Her friend took her to Hillcrest Baptist Medical Center, where she was examined and police were notified, the affidavit states.

According to court records, Waco police Detective John Lyons Rozyskie obtained DNA samples from Elliott on Wednesday by taking swabs from the inside of his cheeks.

Elliott was booked into the McLennan County Jail on Monday afternoon, but his bond was not set by late Monday, a jail spokesman said.

Elliott faces up to 20 years in prison if convicted of the second-degree felony.

A third-year sophomore defensive end, Elliott was listed as a second-team left end on Baylor’s 2012 depth chart after spring drills, which concluded April 14.

Elliott didn’t participate in spring drills or play in the Alamo Bowl because of a knee injury.

The 6-3, 250-pound Elliott finished with 27 tackles and three sacks last year and also returned a fumble for an 86-yard touchdown against Iowa State.

Elliott signed with Baylor in 2009 out of Mount Pleasant High School.
