Former Robinson karate instructor Passmore released on technicality

Former Robinson karate instructor Danny Ray Passmore was released Thursday from McLennan County Jail because of a technicality regarding the legal timeframe for an indictment.
The Texas Department of Public Safety crime laboratory in Austin is still analyzing evidence in the charge of aggravated sexual assault against Passmore and 90 days had passed without an indictment.
Assistant District Attorney Beth Tobin said Passmore could not continue to be held on the $250,000 bond set when he was charged in late May without the grand jury receiving the case.
The district attorney’s office could either request that the bond be greatly reduced, even to a personal recognizance bond that requires no money, or refuse the case so that a judge can set bond again if the grand jury indicts him. The office chose the second option.
Passmore’s attorney, Stan Schwieger, could not be reached for comment late Friday about Passmore’s whereabouts or Schwieger’s opinions about the new developments.
Passmore was arrested May 22 after a former student, a minor boy, said Passmore had touched him inappropriately.
Passmore had already retired from his martial arts academy when the charge was filed.
The alleged incident occurred at Passmore’s home in Robinson, according to the arrest affidavit.
No information on why the DPS analysis was incomplete was available late Friday, but Passmore can be re-arrested if the grand jury returns an indictment based on the completed investigation, Tobin said.
