Man charged in nephew's beating death transferred to McLennan County Jail

Friday, June 26, 2009

The 22-year-old Mexia man accused of beating his 5-year-old nephew to death has been extradited to the McLennan County Jail.

Christopher Mack and his girlfriend, 24-year-old Andrea Thomas of Lacy-Lakeview, are charged with capital murder and aggravated assault, and both are being held in lieu of $525,000 bail.

Mack was arrested Monday in Limestone County and was extradited to McLennan County on Wednesday. A jail spokeswoman said Mack was rearraigned when he arrived in McLennan County. His bail in Limestone County was $1.5 million.

Officials say Sinsear Kirvin, of Mexia, was beaten to death by his uncle Sunday at Thomas’ Lacy-Lakeview apartment. He and his 3- and 4-year-old brothers were hit repeatedly with a belt, officials said.

Thomas is accused of being present at the time of the assault and doing nothing to stop the beatings, call police or seek medical attention, police said.

The remaining children have been placed in foster care by Child Protective Services until a 10 a.m. July 7 custody hearing at the 77th State District Court in Limestone County.

Sinsear, his two younger brothers and 7-year-old sister were being watched by Mack.

They live with their mother, Brandi Mack, and their great-grandmother in Mexia.

I am deeply saddened by what has happen to these kids being a mother myself. My prayer goes out to this family which is a difficult time. I am not a judge nor a jury so I will not pass judgement on anyone. I do know that what one reap they will definitely sow. The young lady involved in this case worked with me and is a very sweet person. The hell, torture and mental physical and mental abuse that she was going through no one knows so that's why we shouldn't be so quick to judge.People have a habit of saying I would have did this or that in actuality YOU don't know what you would have done in her situation. So let God do his job he don't need your help.

I know the pain of loosing a child. And believe me,if my child had of died at the hands of anyone but GOD,they would be dragging my butt back from going after that SOB. Be my BROTHER or whoever the Hell.Somebody else would be doing some hurtin. And I would be doin time for my child.Cause the Hell that baby must have been feeling, had it been my child,I'd be taking care of it. Thank GOD MY CHILD did'nt go through that.Even though I still hurt daily for mine,it wasn't from the hand of another & surely not his uncle.,my brother, or any other family member. At least that baby is at peace now.

Sinsear is my stepson. his dad Marvin Kirven is my husband. I feel bad because there was no way that we could have knowed what he was going though. We plan on getting him and bring him to live with us in Mn. I guess it too late now. It hurt that he had to bare with the abuse. I think that whoever new about those kids been abused and who ever abuse him or any child should get put to rest. That was just a baby. My Sinsear rest in peace.

Sincear is in a better place now. We can't judge or imagine the pain the family is goinng through. Remember, he dosent have to answer to us.It's up to the lord. What he did was horrerific but he will have his judgement day. And as for the comment by Null: the kid is better off dead? that was very unappropiate. May sincears soul, heart, and family be with the lord.

Hopefully, this will be one of the rare and exceptional cases when someone who harms a small child actually will receive a punishment that reflects the heinous nature of the crime. Too often, the perpetrators of violent crimes against innocent children receive little more than a slap on the wrist, to the shame of the criminal justice system and our whole society.
