At a hearing Thursday, Judge Ralph Strother of Waco’s 19th State District Court granted more time for Matt Baker’s Kerrville attorney, Richard L. Ellison, to investigate and take depositions from expert witnesses called by the plaintiffs.
The purpose of the hearing was for Strother to rule on Ellison’s motion asking the judge to throw out the lawsuit, citing a lack of evidence to support the allegations against Matt Baker. That decision has been pushed to a later pretrial date.
Matt Baker, who now lives in Kerrville, was not at the hearing.
About a half-dozen members of Kari Baker’s family were seated in the court.
The family’s attorney, Bill Johnston, said the family is ready to see the case go to trial but is being patient and understanding of the judicial process.
Kari Baker’s death initially was ruled a suicide by sleeping pills, and she was buried without an autopsy or further investigation. Her parents, James and Linda Dulin, pushed investigators to look into their daughter’s death, as they became convinced that their son-in-law had killed her.
After her body was exhumed and the investigation was reopened, Justice of the Peace Billy Martin changed his cause-of-death ruling to “undetermined.”
The McLennan County District Attorney’s Office continues to work on the criminal case against Matt Baker. First Assistant District Attorney Crawford Long said the office is waiting for forensic evidence to be returned.
The case has not gone before a grand jury.
“The civil action is a way of figuring out what happened, alleging it, and then proving it,” Johnston said.
Ellison said he intends to prove that expert witnesses called by the plaintiffs are biased and that their testimony will be based on hearsay.

Passed a lie detector test? Um, no. He stated that he was willing to take one at one point but never did.
Otherwise your post is interesting. Makes one think if so many knew what he was like, why were they attending his church? Why have they never come forward to talk with LE? So many? I doubt it. He maybe guilty but with my own life experience, I say no one can ever truly know if someone is going to kill themselves either. Otherwise suicide would not exist. No one. Not a spouse, not a mother, not a counsellor, no one. (and don't accuse me of knowing Matt or being from Kerville). I am neither.

Does Missy not hear what she is saying? She says that people in Hewitt that knew Matt, the Pastor, saw who he really was. If that was even close to the truth, then all of those people that saw thru and knew what was going on (in their opinion) and did nothing were withholding infomation from the law. If they knew he was a murderer and did nothing, then they have some answering to do. How do they expect the law that they condemn so readily to be able to do their job if they are withholding infomation? Sounds like they jumped on the band wagon after they were given possible outcomes, and how "others" saw it happen, etc. When called to testify wonder if they will really remember their own thoughts of four or five years ago, or will it have been suggested so many times by then that they will not be sure what they remember? However a good psych should be able to get to the truth or lie detector tests. We will have to see how this plays out. People seem to forget that Matt did take a lie detector test and passed, and his attorney has many witness' statements remembering him different that the ones that Missy mentions. hmmmmmmm

Baker hopes there will ONLY be a civil trial. Looks like the DA's office is chipping away at this. My bet is that Baker eventually ends up in prison before this is all over. Sweet boy will be someones wife there.

Billy,
what are you talking about? There have been no friends who have said Kari abused sleeping meds....what are you doing, pulling things out of your rear? Let me guess, you are really from Kerrhell and your name isn't really Billy. You are making up things here and pretending they are factual, Billy...er Matt. There will be a trial. Hide and watch BILLY.

IF the Waco citizen knows what s/he is talking about and only Matt and God knows what happened that night then how can such a case move forward. No evidence? Apparently not any that can be used without some doubt. Do we not believe the medical examiner and come to the conclusion that the cause is undetermined? Do we not take into consideration the mindset of Kari? Do we not believe the doctors and counselors that she was seeing? Do we not believe the statement from her closest friend from earlier media when she acknowledged that Kari had been abusing sleep medications for many years? Or are witnesses being sought that will verify what the parents would like to think happened, thus relieving them of any guilt, only pain and anger? So if only Matt and God really knows ????

Poor Betsy! What will you do when the facts are revealed and you cult members in kerrville no longer can follow "pastor" Baker without looking like your are crazy. And those little girls are truly the victims, alright. Daddy took mommy out of their lives. I feel for you and the betrayal you will feel. thos os us in Hewitt who knew the "pastor" saw who he really was. You see who he pretends to be after he had to leave this area because the jig was up.

Yes, Rex you are so right, can't this family get some justice. I am speaking of the family of Matt and his two lovely daughters that have been put thru hell by their "loving" grandparents. And now to know they will have to wait another year to find real justice. But, the older the daughters become, the more likely they will be to get to tell their story. They were the only other people that really lived with Kari.
