Margaret Mills pretrial hearing scheduled

Thursday, January 24, 2008

By Tommy Witherspoon

Tribune-Herald staff writer

Judge Matt Johnson of Waco’s 54th State District Court has scheduled a pretrial scheduling conference for Feb. 1 in the Margaret Mills felony theft case.

Mills, who turned 67 on Wednesday, was indicted in November in the alleged embezzlement of hundreds of thousands of dollars while serving as head of Downtown Waco Inc., a civic development organization.

The 16-page, 116-paragraph indictment charges Mills with a first-degree felony and alleges she stole more than $200,000. However, Assistant Attorney General David Glickler, who is handling the prosecution of the case, has said that Mills reportedly took about $511,000 from the nonprofit organization, which has since ceased operation.

The Texas Attorney General’s Office agreed to handle Mills’ case after McLennan County District Attorney John Segrest recused his office because of his past ties to Mills and her husband, Waco attorney Coke Mills.

Glickler declined comment about the case Wednesday but said many pending questions could be answered at the upcoming pretrial hearing.

One of Mills’ attorneys, Pat Beard, said Wednesday that “we have nothing to report at this time.”

He said he has received some information about the allegations from Glickler, adding that he and co-counsel Rick Bostwick are reviewing the material.

The judge said he hopes to determine next week when the parties in the case will be ready to proceed and to set a realistic trial date. He called the conference a “typical pretrial hearing, just like we have in any criminal case.”

Mills remains free on $25,000 bond.

According to the allegations, since April 2003, Mills accepted checks from outside organizations on behalf of Downtown Waco Inc. but actually deposited those checks into her personal accounts or those she controlled.

Prosecutors believe Mills deposited as many as 116 checks into her personal accounts, according to the indictment.
