Another tax lien filed against Waco state Rep. Anderson

By Michael W. Shapiro Tribune-Herald staff writer

Friday February 5, 2010

About a month after filing a $58,000 tax lien against state Rep. Charles “Doc” Anderson, R-Waco, for unpaid personal income taxes, the Internal Revenue Service took further action against the veterinarian for failing to pay taxes withheld from employees’ paychecks for the final two quarters of 2008.

The lien was filed at the McLennan County Clerk’s office Jan. 25 and totaled about $11,500. It was placed against the Anderson Veterinary Hospital, the clinic Anderson opened on Valley Mills Drive in 1983.

At a press conference Anderson scheduled after his office received a call for comment from the Tribune-Herald, he said the two recent liens stemmed from the same problem.

Doc Anderson explains to reporters at a news conference Thursday the circumstances behind an IRS tax lien filed against him about a week and a half ago.

Anderson characterized the latest lien as “part of the previous thing.”

“We’d hoped to have (it) resolved by last week,” he said.

Anderson said he already had sent the IRS a check covering what he owed the government.

Earlier issue

The previous lien was filed Dec. 21, 2009. Anderson and his wife said it happened after they missed two payments on a plan they worked out with the IRS to repay personal income taxes owed from 2003, 2006 and 2007.

According to records from the county clerk’s office, neither of the liens had been lifted as of Thursday afternoon. Anderson said both liens already would have been removed but for the bureaucratic nature of the IRS.

Still, with his check sent, Anderson said he expects the liens will soon be a thing of the past.

“It’s great to be able to say that,” he said.

The news, however, prompted McLennan County Democratic Party Chairman John Cullar to call for Anderson’s resignation.

In a press release, Cullar referred to Anderson’s history with the IRS, which has filed liens as a result of unpaid personal income taxes and payroll taxes before and after he took office in 2005.

“Those who defend Doc say he can’t pay his taxes because he’s too busy working for us in the Legislature and isn’t working enough in his veterinary clinic,” he said. “But not only has Doc not paid his taxes while in office, he didn’t pay his taxes before he was elected, so that dog won’t hunt.”

Public records

John Mabry, a Waco Democrat challenging Anderson in November for his seat, referred to public records that show Anderson failed to pay taxes for six years going back to 1998.

“One time is maybe an accident,” Mabry said. “Twice might be a coincidence. But six times is a lifestyle and a pattern that proves he’s either too incompetent or too careless to manage his own affairs or our affairs as a representative in the state House.”

Anderson serves on the House Pensions, Investments and Financial Services Committee; the Agriculture and Livestock Committee; and the Rules and Resolutions Committee.

He unseated Mabry, who held the seat from 2003-05.

McLennan County Republican Party Chairman Joe Hinton said it’s not surprising Democrats are making an election issue out of the tax liens.

He said Anderson will remedy his problem and get sent back to Austin based on his reputation as a conservative.

“If he gets straight with the tax man and continues his voting record, he’ll be a representative for a long time,” Hinton said.

Anderson said he’s taken steps to help avoid future run-ins with the IRS, including having his accountant send him frequent status updates on his taxes.

He also made clear he has no intention of stepping down and remains committed to achieving his legislative goals.

Legislative objectives

He cited several tax-related ones in a prepared statement.

“I will continue to work to see that Texans remain free of a state income tax and that Texas taxes are (as) low as possible and that their collection remains fair and reasonable,” Anderson said.

OnePettLuvrr, no one questions him on his veternarian skills. But just like you don't call a plumber to do your taxes, you don't send a veternarian to be a law maker. Most people have already agreed, that he doesn't do his own accounting. But he's been having tax and/or accounting problems for over 11 years. If he doesn't have the skill and knowledge to hire an accountant that can get his taxes paid, how can we expect him to make wise decisions on complicated financial matters in our state government? It's jsut simple common sense. If he couldn't properly take your pet's temperture, would you let him operate on your pet? It's the same principle. He hasn't been able to handle the small job of properly running his business, we shouldn't allow him to run our state business.

Doc Andersen is by far the best veternarian in central texas. When he gets his act together with the IRS situation then he will be the best legislator in Austin. No doubt about it. As a veternarian he is head and shoulders above the rest of the doctors. This tax thing is not so bad. We all make some mistakes. Nobody is perfect.

Archie you should stick to the politics of Sponge Bob, because you are the exact type of person that as Kyle put it, looks only at the letter at the end of a candidate's name. Democrat isn't an automatic liberal, and Republican is an automatic conservative. Those are party associations that both run the full gambit of political views. Texas for example has a 160 year history of being a conservative state. Yet, in being a conservative state, Texas has had a total of 6 Republican Governors with 4 of those elected in the last 30 years. In fact, Texas had a streak of 105 years of Democrat Governors all while being consider one of the most conservative states in the nation. So stop looking at the letters at the end of a candidate's name. Find out about the candidate's beliefs. Again as Kyle pointed out, Marby's beliefs and such fit more with conservative beliefs. In fact on the issues, he leans more to the conservative right then Doc. He also support our interests that Doc has voted against more then a few times. If you really want to be represented by a true conservative, then vote Marby. If you just want someone who represents the party instead of you, vote for the stooge, Doc.

I don't think that any business owner pays there own taxes. Most owners tend to have an accountant responsible for all financial matters. If anyone is at fault it would be the accountant for not making sure that the bills are paid.

Everyone keeps calling mabry a liberal, where is the proof? He may be a trial lawyer but that doesn't make him a liberal. For every car accident he works on, he represents a business owner over a dispute. Look at his record. He was endorsed by the NRA during the last election, doesn't sound very to liberal to me! The problem with America is we look at the letter at the end of a candidates name rather than what he represents. Look at the candidates, the choice is easy.

Liberal or conservitive, wrong is still wrong. Doc has been doing wrong for 11 years now. We need to get the colorblind people off the party bandwagons. Neither has done anything to take care of the people. I will say this about Mabry, he does appear to be the lesser of 2 evils in the case. I do remember hearing that he did win Freshman Representative of the Year and passed a few bills he wrote as a Freshman. Has Doc written anything that has passed to date? Marby gets my vote. I will not vote for a cheat, especially a proven cheat like Doc. I do hope more people take the time to take off their party blindfolds. You might find that there are more lberial Republicans and conservative Democrats then you would ever believe. I do remember a time when Republican in Texas meant untrustworthy yankee liberal.

First, the Democrats would have nothing to go after, liberal media or not, if Mr. Anderson had done nothing wrong. Second, while I am neither a Republican nor a Democrat, it amazes me that the party that always touts that they take the high road and are morally superior, the Republicans, are generally the ones caught committing crimes of moral turpitude.

Only in the "conservative" heart of texas would a guy who doesn't pay taxes be a state representative. this isn't about washington, this isn't about illegals, this isn't about anything other than a guy who is supposed to be a leader who refuses to pay taxes. This is money he withheld from paychecks. What did he do with that money. It's ok, we will continue to talk about how terrible things are and no one can be trusted and the govt is full of a bunch of crooks but when it happens in our own backyard we close our eyes and blame the media, liberals or anyone else that doesn't agree with us. Doc, you lost my vote. Unfortunately i am not going to vote for Mabry...guess it's a lost cause.

I love watching blind people make comments. You people have been so blinded by the lights and mirrors you can't see the train coming straight at you. Anderson is nothing but a rubber stamp for a party. He has voted against our interests here in McLennan County in favor of the party a few times. He's a good Vet, but a good vote doesn't make for a good representative. He has a long history of unpaid taxes, that what in the criminal justice world is called an habitual offender. Not paying Employee taxes is stealing from the employee. I see that people mock Culler, because unbeknownst to him his law partner's wife stole money. So where does that put Doc who actually stole money from his employees? You want to talk creditibility on an issue of our Representative stealing money versus a party chair's lawyer partner's wife stealing money, you haven't a leg to stand on. McLennan county needs to stop choosing parties based on their popularity and start looking at the people we are electing. Stop sterotyping and look at the person. Stop trying overlooking a person's pattern of crimes while concentrating on someone else's partner's wife's mother's friend's roommate's cousin. Stop being lead by the nose Waco and get out there really look at the facts. Doc Anderson has an 11 year history of "taking cetain liberties" with his taxes, which is a fairly long history.

Remember this is a year for redistricting and Dunnam wants his "buddy"/co attorney John Mabry with him so they can run back to Oklahoma or New Mexico as they did before. Having 2 attorneys from the same office did not work in the past and will not work in the future. Was John Mabry the best candidate they could find to fun against Doc. Give me a break Demarcates, you play dirty all we all know it. I am proud of my representative Charles "Doc" Anderson because he works for us, the citizen not like Dunnam and Mabry looking just for their own interest. If John Cullar wanted to help out he should have made sure that Mills kept her hand out of the cookie jar when she took all that money from the citizens of Waco.

Failure to pay his own taxes is one thing, but Anderson's failure to pay withholding taxes on his employees is tantamount to theft. Those were never his funds to manipulate. At the end of the day, Anderson is still a tax cheat ~ and one who has no problem breaching the trust of the people who work for him to pay their withheld taxes. His reputation may be laudable as a state representative, but his personal character appears a bit questionable.

I'd hope people would see this for what it is... Coincidences do not happen in politics. Doc Anderson gave a press conference yesterday on the past liens that had been resolved, yet COINCIDENTALLY the news nearly simultaneously breaks that another lien had been filed dated nearly two weeks ago? Please... This is almost certainly a hit-job by his opponents in the upcoming November election. Doc has been working hard to reslove these issues, but this is how Democrats and liberals, like Mabry and Dunnam, play the game... They know they can't beat the guy on ideas, so they try to tarnish his reputation as a gentleman and a statesman. It's dirty and it's low, but they know they also have a compliant media led by the likes of Carlos Sanchez, Bill Whitaker, and Dan Savage, who all edit the content of this paper. It's a sick game being played by the liberals out there... Yes, Doc has tax issues that he's shown initiative on resolving quickly, but don't let that fool you on what's happening behind the scenes... This is a concerted effort by Democrats using a compliant media to take out a good man and statesman that they do not agree with... It is about THEIR power and turning the Texas House blue this November

John Cullar's indignation over Anderson's tax problems is a bit hypocritical. Don't forget that when Cullar's law partner's wife, Margaret Mills, actually stole over $500,000 from Downtown Waco, Inc., he assisted her in attempting to excuse her theft as merely "taking certain liberties". If the local Democrats are going to call for Anderson's resignation, surely thay can come up with someone with a little more credibility than John Cullar to do so.
