Kip Averitt ponders keeping State Senate nomination if Brian Birdwell wins runoff

Today's special election between Brian Birdwell and David Sibley will determine the who will fill out the the last six month's of former Sen. Kip Averitt's term. It could also determine the Senator for the next legislative session but that assumes Averitt pulls his name of the November ballot, which hasn't happened yet.
In a new twist, however, Averitt said he might remain the GOP nominee if Birdwell wins.
Birdwell's critics have argued he hasn't been a Texas resident for the last five years, making him ineligible to run for the seat. The argument typically gets extended to say that if Birdwell emerges victorious and is subsequently selected to replace Averitt on the ballot, the Democratic Party would file suit and take the seat. (U.S. Rep. Chet Edwards is the last Democrat to represent all of McLennan County, and his time in the State Senate dates to the 1980s.)
Averitt said that scenario had him concerned enough to consider holding onto the nomination in the event of a Birdwell win.
"I'm hoping my friend David Sibley will win and there won't be anything to worry about," he said. "It's nothing personal against Mr. Birdwell but it's just a question of whether he's eligible."
"I really don't want to go back to the Senate, but I feel like I'm now physically capable of doing so if I have to," he continued. "We need to make sure there's a Republican candidate on the ballot."
The Austin American-Statesman and Texas Tribune have interviewed Averitt about his thoughts on staying on the ballot. In a Tuesday interview with the Tribune and a subsequent interview with the Waco Trib, Averitt entertained more seriously the idea of returning to the Senate.
Assuming Averitt does pull his name off the ballot, two sets of county party chairs (Democrats and Republicans) from the 10-county senate district would select nominees for the November contest.
The Sibley campaign has long argued that Birdwell's not eligible to vie for the seat, as did Darren Yancy and Gayle Avant, who competed in the May special election, but none of the candidates mounted a legal challenge.

4500 people saw Sibley for what he is in Mclennan County Sodbuster. A paid for lobbyist for TXU and utility people. Anti Coal people showed up in droves to oust Sibley for his support of 5 coal plants in Mclennan County. Those 4500 made the difference

The discouraging outcome of all this - just over 24,000 voters decided this election. Almost half of those votes were cast in McLennan County.
Dear Kip, We are onto you. I would suggest you not even consider taking your Senate seat back. The voters of this district and myself will make it our obligation as a citizen of this great state of Texas to devote our souls and time to reveal to all the residents of this district the corruption that Mr Decluitt, Mr Sibley, Kip Averitt, and yourself have created and are trying to cover. Leave now while you still can.
Kip wants to keep the dirty "family secrets" about their Brazos River Authority money scam “hush, hush”. If Birdwell gets in, he’ll reveal the fact that Averitt, along with Chris DeCluitt and David Sibley, have been milking the taxpayers hundreds of thousands dollars is erroneous bond issues to fill their Ridgewood Country Club, McClennan County Republican party club coffers for the last five years. The chair of the BRA, (Chris DeCluitt), is now under investigation for corruption by the Securities And Exchange Commission; which is also linked to Kip Averitt. Sorry, Averitt, DeCluitt, Sibley, Taylors, and Hinton – your time is up and cover is blown. Own up to your corruption and take your medicine like men!
Richard, that court case was a joke. Birdwell conveniently left off all intersted parties in the legal matter and purposely left out critical documents so that the ruling would come out in his favor. Any appeal of the ruling would be sustained. However, if the national democratic party sues to find birdwell ineligible, they would surely win once all facts are brought to light. What a couple of whiny wimps. "I'll put my seat up for grabs, but, if I can't have it my way, I'll take my marbles and go home." He should be forced to reimburse everyone for their gas to drive to the polls, and $10 for an hour of their time.
Kip, stay and don't leave Waco to twist in the wind. We need a rep in this next session. Badly.
Kip you need to go and do what you were going to do, lobby. You were sick and now better one hour after the election that saw your buddy lose big time by 8 counties. Time to move on Kip.
This does not make sense. Sen. Averitt, would not waste 50 thousand dolars for no reason. The election is over the voters have spoken. The speculation that he might not resign is very discouraging and disrespectful to the voters. Mr. Averitt. Would be wise to put his time and new found energy into his Family!
This is the start of redistricting - another dirty crooked fight at taxpayer's expense. Independent Texans
"If this is the Republican plan to hold the seat in December, then the Dems are probably going to win." Under Texas election law, if Averitt keeps his name on the ballot, the Democrats will not even be allowed to select a candidate, meaning Averitt will run unopposed and win by default.
Chris you and I disagree about everything but you are dead on. This is the worst mess I have ever seen. The old guard needs to leave. Kip was sick and now he is well and the election is over by a hour. People will not stand for it
Kip, Leave on a high note. This is a clear message that SD22 wants new leadership. Thank you for your service Kip but Brian won 8 out of 10 counties.

I don't have a dog in this hunt, but it's blatantly obvious that Averitt has been trying to hand the seat back to Sibley all along.
The one fact that Sibley and Averitt keep seeming to conveniently forget is that Birdwell's residency was already ruled on by a judge on April 26th, 2010. John, this is not the Republican plan to hold the seat, it is the RINO plan to keep the seat in RINO hands. No Republican, especially the SREC reps, county chairs, or precinct chairs should recognize Averitt as the Republican candidate until he reimburses the counties and the state for the cost of the special election and subsequent runoff.
I think that Kip has a lot more confidence in himself than his constituents. This whole debacle is due to his trying to give the seat to Sibley through his "belated" decision to vacate the post (thus causing a very expensive elction and run-off). If this is the Republican plan to hold the seat in December, then the Dems are probably going to win.
