Update: Arrest affidavit says 5-year-old beaten to death in Lacy-Lakeview

Arrest warrant affidavits state that 5-year-old Sincear Kirven of Mexia was beaten to death Sunday by his uncle, who struck the boy and his 3-year-old brother repeatedly with a belt.

Christopher Mack, 22, was arrested Monday in Limestone County, and is being held in jail there on charges of capital murder and aggravated assault in lieu of $1.5 million bail.

Andrea Shante Thomas, 24, the woman with whom Mack was living, also was arrested on those charges Monday, and is being held in the McLennan County Jail in lieu of $525,000 bail.

The boys were staying with their uncle at an apartment at 1708 E. Crest Drive in Lacy-Lakeview, the affidavit states. Just before midnight Sunday, Lacy-Lakeview police were dispatched to Providence Health Center in connection with the alleged beatings.

Mack had driven Sincear to the hospital, and told doctors that the boy collapsed in the apartment.

The affidavit states Sincear had “extensive visible injuries” including “bruises, abrasions and lacerations to his head, arms, front and back torso and legs.” Marcavion was brought to the hospital by another family member, the affidavit states, and was said to have suffered similar injuries.

Police later learned from talking with witnesses that Mack had repeatedly beaten the boys with a belt. The affidavit states that Sincear was beaten until “he passed out and was not moving.”

According to the affidavits, Thomas was present at the time of the beatings, and did nothing to stop it, call the police or seek medical attention for the boys.

Medical staff told police that Sincear had been dead about an hour at the time when he was brought in by his uncle. Marcavion has been treated for his injuries and released from the hospital, according to a news release issued today by the Lacy-Lakeview Police Department.

It is unclear why Mack, who is reportedly from Mexia, and his nephews were staying in Lacy-Lakeview. The news release states that Mack was watching the boys for the Mexia-based family.

An autopsy has been ordered on Sincear’s body.

This fool should try this senseless crap with a man his own age. I bet this guy’s heart is really pumping kool-aid. One thing that really p** me off is some adult person beating up on a child. A spanking, yeah. That’s one thing. This ‘ol coward must have been high on something to beat this kid to death. The lady with this guy obviously didn’t try to do anything to save the kids. I just don’t see why or how some women in today’s society condone a guy’s behavior and actions just to stay with him. Men and women come a dime a dozen. How could anybody side with a loser like this over an innocent child.

Dang, what kind of belt was he using? To beat a child to death is unbelievable at some point I know that poor child had to be tired of crying that he just gave out. That is truly sad and for a woman probably a mother herself to sit back and do nothing! Umm what a shame.

Let me guess, his Daddy was an abuser too and he was on drugs and didn’t know what he was doing. How you can take a little 5 year old kid and beat them to death is beyond me. Where is the father and mother? Why wouldn’t you just leave them at any number of safe houses rather than beat them or in this case kill them. He deserves exactly the same thing he dished out. You cannot rehab a person that is capable of this. The bad thing is, he will get less of a sentance than someone that tortured an animal. I can just see that child getting hit by a grown man so many times that he just passes out and cannot cry anymore. His brother? What something to have to remember. the parents should be charged for leaving them with these two idiots as well. Hopefully they will get the death sentance!

PATHETIC! This man and woman should suffer the worse type of punishment! What kind of sick person does this to a child, they should get what is coming to them in prison for the rest of their lives. SICK, demented, evil people like this don’t deserve the oxygen we breath!

I am not a supporter of the death penalty, but I am a supporter of some people never living in our free world again and these are some of those people. If these two are guilty of this, I hope our legal system will make sure they are both put away for good, that they will plead guilty and no 12 jurors will have to look at the photos of their destruction.

Sweet Jesus, let that poor child rest in a better place than he found on this earth. And for the one who was spared, give him the strength and faith to never harm another in the way he has been harmed.

Nasty people .. We are here for six months on a work related assignment and I made the misfortune of picking an apartment near work in Bellmead …It is filled with folks just like this .. I thought at first these were some of my neighbors …

Ms. Adrienne Scott. This is public media. We are free to comment all we want. If something is said out of context, such as cussing somebody out, the newpaper will surely edit it. I for one am not going to engage in a simple battle of words with you on paper. There are laws in this country that entitle me and others to give our opinion. At the same time, I don’t think anyone here would allow you to threaten them in person. Making threats is against the law also. Regardless, I believe that the guy who beat this child to death needs to have his butt kicked by a grown man. If your sister knew that the guy was beating the kids, your sister needs to have her butt kicked also. That’s my opinion. I wouldn’t waste my time, my gas, or my breath trying to discuss anything with you. I don’t owe you anything. Not even the time of day. A 5 year old kid got beat to death, and it seems like you are trying to shift blame somewhere else. Apparently, you need to get a life.

The fact is, there is a dead child. There can be NO Justification for killing anyone, especially not an innocent child. There can be no justification for allowing it to happen. If any witnesses to the beating/killing are out there, I would hope they will be punished as well. And let us all hope that the ones who are guilty of the crime will get a suitable punishment. There is a reason we have the death penalty and we’re looking at it in this article. Can you imagine letting this killer out of jail so he can do this to someone else’s baby? Save the defense for the courtroom, and save money with a bullet rather than lethal injection.

Well by reading Adriennes comments we can see what kind of people we are dealing with here. Looks like shes ready to take a belt to everyone here. Guilty or not, did she leave them in his care? We may never know but if she is arrested then they dont just take them in for no reason..its called endangerment. Keep throwing your threats out there so they can pick you up too.

I want everyone to think back to when your child was 5. This is when they still get excited about the smallest things from band aides on healed scars to the ice cream truck just driving by. Do you remember holding your 5 year old’s hand? Do you remember how soft and small it was compared to yours? Do you remember getting your 5 year old ready for the first day of school; the new clothes, new back pack, fresh hair cut and a clean face. What in the world did this baby do to deserve being beating to death. Let us all realize that if a dog was treated this way, these ‘people’ would be on the county’s sh*t list. Ms. Scott, please tell us the ‘whole story’. Please tell us what these kids did that made it alright for a grown man to beat them. The baby that died is definitely in a better place. He is in a place where he is ALLOWED to be a child. He is allowed to laugh and play. My prayers are for the children that were not only witnesses but victims to these sorry excuses for adults. Ms. Scott, I understand having your family’s back but this is pityful. I want these “people” along with Ms. Scott to have to sit in the counseling sessions with the surviving kids. I want you to sit in the funeral home as the directors TRY to cover this baby’s battle scars. I want you to sit next to his coffin and look at his parents and grandparents faces as the preacher tells them tomorrow will be easier, Ms. Scott. I have NO tolerance for abuse! Ms. Scott evidently your not a mom and my hat goes off to Roma Salis, she nailed it. There are some things that don’t make sense and your protecting your sister is one of them. Those babies were as much as her responsibility as it was Mack’s, so she deserves everything she will get. Those two don’t only have to stand in front of twelve of their peers but come judgement day they have to stand in front of our maker {GOD}they will pay. It really makes me wonder what kind of people hears crying like those babies were doing and nobody helped. That makes them just as responsible as the two that did it.

This is a sad situation..Its even sadder to say that the people that know this family should have seen this coming…..But we never thought that it would be a fatal & such a tragic situation that would remove these kids from there home…The 3yr old was in a very decent home for over a year were he was loved by everyone he came in contact with, but he was taken for the TLC he was receiving to be back with the beast of family members for him to get beat at the end….At this time all I can do Is feel sorry that “Sincere” (GOD BLESS his sole! R.I.P.!) but he is truely in a better place..For all of the other kids God Bless them as well…I Pray & hope that they are placed into a very loving home because these kids have been through enough in the short lifetime, please just be patient with them & LOVE THEM UNCONDITIONALY!!!As for Chris, he need to be beat just like he beat these kids…Because he put up a front like he would never harm a hair on there heads & that he love them more than there own mother…I hope that he gets the death sentence…I know that I will never see that child again, none of these kids…They are lost in the CPS system for the rest of their lives….But for that one child that touch so many hearts & captured the love of me as well so many others I LOVE YOU FOREVER!!!!!

To MS SCOTT, your post is pathetic to say the least, who gives a rats a$$ what your opinion is, this woman(your sister) sat there and watched this evil person beat a 5 year old to death..come on how and why are you defending her, sorry no excuses!! She is just as guilty as this pathetic, low life loser that killed his nephew and if you read what it says there were bruises, etc on this poor child which means it had to have happened for a while or before he died. You can sit and defend your trash sister till you are long gone but GOD knows what evilness she carries and for you to sit there and tell us you will take it up with us..HA you are just as stupid as these 2 that killed this boy, perhaps she will close her eyes and see this nightmare the rest of her days in her jail cell with only a small window to peer out of, she doesn’t even deserve that much.
