Man pleads guilty to intoxication manslaughter in Waco man’s death

Jason Modgling, 29, pleaded guilty today to intoxication a manslaughter charge in the May 2008 drunk driving death of Adam Martinez Jr., of Waco.

Modgling, of Saginaw, Texas, asked that a jury assess his punishment and he is asking for probation, his attorney said. A jury of six men and six women was chosen today.

The wreck happened on Interstate 35 near Elm Mott. Authorities said Modgling’s blood-alcohol level was 0.15.

I am glad to see justice served in this case. Adam was a fine upstanding citizen in this community - he is greatly missed.

May the justice system see it served. Adam was an amazing person, with a wonderful smile and a good heart. This man, while I don’t know him personally, is and should be held responsible for the death of such a great soul.

He should get more than probation. He took someones life. And this life was worth more. He took someones son, someones brother, and someones friend. It still hurts to this day to know that Big Adam is still gone. He will never be able to start a family, finish college, and live a normal life. Its still really hard to deal with for a lot of us, even after it being a YEAR!!! He is missed everyday and still loved as if he were still alive. Adam you are loved and missed dearly. Its tragic that your life had to be taken away by someone elses carelessness!!

I am happy that justice is finally being attempted in Adam’s death. I pray that this jury does the right thing and does not give this person probation. It is time that people start being held responsible for what they do. We also need stricter drunk driving laws. This family, and many others who have had to live through this kind of pain, has been through so much during this past year. Probation is too easy. Adam will not get an another opportunity to show the world what an fine, outstanding son, brother, uncle he could have been. Maybe Modgling, should be made to sit and listen to what Adams family and friends have to say about this amazing young man and what he could have done in life. Mr Modgling, you do not deserve probation, and I hope justice is served.

This man needs more than probation for the death of my cousin, he should suffer the way that my Uncle has. Adam did not deserve this and my family has to live with the fact that we will not be able to see him again. So I hope the juror finds him quilty and the judge gives him more than what he is requesting, he does not deserve to be out in the free to get drunk again and drive and hurt someone elses family.

i am the sister of jason modgling and my prayers go out to the martinez family as well as my brother. despite what some of you might think my brother is a very caring and loving person with a big heart he means the world to our family and yes he made a mistake i will not sit here and make excuses for my brothers actions becuz he messed up but he wasnt the only one drinking that night and adam should of been wearing a seat belt so two people made mistakes in this situation this was nothing but a tragic accident my brother had no intention of hurting anybody. i can not begin to understand the pain the martinez family is feeling and our pain may not be as great as that of the martinez family but our family is losing a great person who is very important to us yes he will come back to us but his life is forever changed and he will never be the same again i as a parent couldnt imagine losing my child my family is very sorry for there lose and our prayers go out to the martinez family .my brother is a wonderful father brother nephew uncle and son and im sure adam was a great guy himself but do two lives have to be lost becuz of a mistake?? my prayers will continue to go out to the martinez family and i thank his mother for forgiving my brother forgivness is sometimes a hard thing to do and i know that my brother as well as my family appreciates it.
