Watch video: Jury recesses in trial of former Aryan Brotherhood member who led police on chase

A former captain in the Aryan Brotherhood of Texas will have to wait until Thursday to learn his punishment for leading state police on a high-speed chase through northern McLennan County.

Scott Allen McLain, a three-time convicted felon, pleaded guilty Tuesday to eluding police in a vehicle and elected to have a 19th State District Court jury of nine women and three men recommend his punishment.

The jury deliberated about 5 1/2 hours today before asking Judge Ralph Strother if they could recess and resume deliberations in the morning. Jurors, who said they were deadlocked after about three hours, told the judge that they were making progress before they left for the evening about 6 p.m.

You can watch the chase video from the trial below:

BU administration overturns tenure denials for seven faculty members

By Tim Woods Tribune-Herald staff writer

Baylor University President John Lilley announced in an internal e-mail today that he and Provost Randall O’Brien granted tenure on appeal to seven of the 12 tenure candidates who were denied earlier this spring.

“As a result of new evidence submitted in the reconsideration process, this year 25 of the 30 faculty who applied for tenure will receive it,” Lilley wrote in the e-mail.

Originally, 12 of the 30 were denied, with Lilley’s administration pointing to substandard research viewed “through the lens of (Baylor) 2012” as the reason.

The e-mail did not name the candidates awarded tenure on appeal, but it has been confirmed that three of them are from the engineering department— Russ Duren, Randall Jean and Carolyn Skurla.

Lighting sparks house fire

Lightning struck a home in Elm Mott this morning, sparking a fire that badly damaged the vacant home’s roof.

The fire started during a severe thunderstorm. Firefighters were called about 7 a.m. to the 1100 block of Farm-to-Market Road 308, said Elm Mott Volunteer Fire Chief Ann Reed.

The fire damaged the home’s roof and a breezeway leading to an attached pool house, Reed said. A firefighter lost footing and fell in the pool as they tried to put out the flames.

The home, approximately 2,500 to 3,000 square feet, was vacant, as its owners were in the process of putting it on the market to sell, Reed said. No one was injured in the incident.

Officers: Suspect gives details of killing spree

Within hours of his arrest in New York, a suspect in a cross-country killing spree offered details about murders and shootings in Texas, Pennsylvania and other states, law officers testified in Austin.

Paul Devoe was arrested in his native Long Island in August as the suspect in six slayings. Officers from Suffolk County, N.Y., where he was arrested, testified about his initial statements Tuesday during a pretrial hearing in Austin.

Devoe is charged with capital murder, and prosecutors are seeking the death penalty. His lawyers are trying to suppress statements he has made in New York, saying in court documents that they were not voluntary and were not secured in accordance with Texas law.

Study: Sea wall sinking around Jefferson Memorial

The sea wall protecting the Jefferson Memorial in Washington, D.C., from the Tidal Basin is sinking in spots and needs repair, a study concluded.

The domed landmark built in the late 1930s and early ’40s is not in danger but should be monitored, according to the yearlong engineering study commissioned by the National Park Service.

The study released Tuesday attributes the sinking mainly to soft soil under the wall that has compressed over the years. In some places, the wall has sunk almost a foot since the memorial was built.

Consumer prices rose less than expected

Bloomberg reports that U.S. consumer prices rose less than forecast in April, reflecting cheaper costs for cars and hotel rooms that offset the biggest jump in food in 18 years.

The consumer price index increased 0.2 percent after a 0.3 percent gain in March, the Labor Department said today in Washington. So-called core prices, which exclude food and energy costs, climbed 0.1 percent, compared with 0.2 percent.

Bonds rallied after the report, which may be welcomed by Federal Reserve officials after they warned two weeks ago of “high” uncertainty in the outlook for prices. The central bank has for most of the past year predicted that a slowing economy would hold down prices.

Pregnant woman rescued from China quake rubble

A Chinese woman — eight months pregnant — was pulled to safety today after spending 50 hours trapped under earthquake rubble, setting off celebrations among beleaguered rescuers.

Rescue workers pulled the pregnant woman’s elderly mother to safety minutes later in the same place in rare good news in Sichuan province, where the official death toll has risen to nearly 15,000 from Monday’s massive quake.

But up to four others remained trapped in the collapsed apartment building and the prospects for reaching them were slim, a rescuer said.

In other news, thousands of Chinese soldiers rushed to repair a dam badly cracked by the earthquake, while rescuers arrived for the first time in the epicenter of the disaster.

China’s top economic planning body said that the quake had damaged 391 mostly small dams. It left “extremely dangerous” cracks in the Zipingpu Dam upriver from the earthquake-hit city of Dujiangyan and some 2,000 soldiers were sent to repair the damage, the official Xinhua News Agency said.

Arson arrest made in string of Florida wildfires

Authorities in a Florida town where at least 40 homes have been gutted by wildfires have arrested a man they believe may have sparked the blazes, the Associated Press reports.

Palm Bay Deputy Police Chief Doug Muldoon says the man was arrested this morning. No other information is being released until a news conference with other city officials.

The fires reported in Brevard County have burned more than 15 square miles. Officials say they’re getting closer to containing the blazes.

The Florida Division of Forestry says 40 homes in the Palm Bay area were destroyed and about 120 other structures were damaged. Officials said the total damage estimate was approximately $9.6 million.

Substitute teacher came to school drunk

A substitute middle school teacher in Richardson, Texas, suspected of being drunk in class was too intoxicated to complete a sobriety test and was arrested, authorities said.

Thomas Brownlee, 56, was in a classroom Tuesday with students and another staff member for about 20 minutes, Richardson school district spokesman Tim Clark said. Another teacher suspected Browlee was drunk and told a campus police officer.

A Dallas police report states that Brownlee “had slurred speech, breath smelling of an alcoholic beverage and bloodshot eyes.”

The officer stopped issuing a sobriety test out of concern for Brownlee’s safety, according to the report.

Brownlee was charged with public intoxication, police said.

Clark said students were never alone with Brownlee, and that the district had used him as a substitute teacher before without incident.

5th person charged in Redskin safety’s murder

Prosecutors in Miami say a fifth person has been charged in the slaying of Washington Redskins star Sean Taylor.

Miami-Dade County State Attorney’s Office spokesman Ed Griffith says today that 16-year-old Timothy Brown is charged with first-degree murder under a sealed warrant.

Taylor died of massive blood loss after he was shot at his Miami-area home during a botched robbery in November. The 24-year-old safety had made the Pro Bowl in 2006 and 2007.

Brown is being held in Lee County. It’s not immediately known when he’ll be transferred to Miami-Dade County to face the charge.

Trial for the other four suspects is set for Aug. 25. Prosecutors have said they will not seek the death penalty.

New storm headed to cyclone-ravaged Myanmar

Another powerful storm headed toward Myanmar’s cyclone-devastated delta today and the U.N. warned that inadequate relief efforts could lead to a second wave of deaths among the estimated 2 million survivors.

The country’s junta told visiting Thai Prime Minister Samak Sundaravej, however, that it is in control of the relief operations and doesn’t need foreign experts.

By the way, the news of a second cyclone was not broadcast by Myanmar’s state-controlled media. But Yangon residents picked up the news on foreign broadcasts and on the Internet.

The area was hammered by Cyclone Nargis on May 3, leaving at least 34,273 dead and 27,838 missing, according to the government.

An estimated 2 million survivors of the storm are still in need of emergency aid. But U.N. agencies and other groups have been able to reach only 270,000 people so far.

Curfew in Indian city after deadly bomb blasts

Police imposed a daylong curfew in the western Indian city of Jaipur today to prevent any retaliatory violence after a series of blasts in crowded areas left at least 80 people dead.

Authorities suspect Islamic militants were behind the blasts, and they moved quickly to stop any potential clashes between the city’s Hindu majority and its sizable Muslim minority. Police were deployed in force and people kept off the streets of Jaipur’s old walled city, where all seven bombs went off on Tuesday.

“Neither the Hindus or the Muslims here want to fight,” said Mohiuddin Qureshi, a gemstone trader who works in a market that was bombed.

“Our lives are together, our businesses are together. This is the work of outsiders,” said Qureshi, who went to 10 burials Wednesday.

American Eagle flight left late due to storm

From Trib staffer Erin Quinn:

The first flight from Waco to Dallas this morning left more than two hours late because of severe weather, said Andrea Huguely, an American Eagle spokeswoman.

Richard Howell, director of aviation at Waco Regional Airport, reported flights to Dallas were on a “ground stop” this morning. Huguely said all flights at Dallas-Fort Worth International Airport were grounded because of severe storms and lightning.

All flights leaving DFW are running at 15-minute delays now, she said.

American Eagle flights leaving Waco appear to be running on time now. The next flight is scheduled to leave at 9:38 a.m.

The first flight was scheduled to leave Waco at 6:20 a.m. and did not take off until 8:29 a.m., according to the American Airlines Web site, which Huguely confirmed.

American Eagle, a subsidiary of American Airlines, provides service from Waco to Dallas. Continental Connection flights, which fly from Waco to Houston, were not affected.

Huguely urged people flying into DFW today to check aa.com for their flight status before leaving for the airport because the Dallas-Fort Worth Metroplex is bracing for another round of severe weather this afternoon.

Some in county without power this morning

From Trib staffer Erin Quinn:

About 2,000 McLennan County residents are without power this morning, reports Oncor spokesman Mike Cain. He said the outages are widespread and were caused by the wind and lightning accompanying the storm.

Power lines also were down in isolated spots around the county, he said. He could not give an exact number, but said that crews are working to restore power.

Cain says anyone who spots a downed electric wire to stay clear of the area and call 9-1-1.

Drizzle now, but more storms possible

We have just a little drizzle in downtown Waco right now, but the high humidity (87 percent currently) and an expected warm day leads to the likelihood that showers and thunderstorms will develop during the day, according to the National Weather Service.

Some of the storms could be severe, the weather service says. It’ll be cloudy, with a high near 82. A southeast wind between 5 and 10 mph is expected with a 70 percent chance of rain.

According to the automated rain gauge at Waco Regional Airport, the storm brought 2.94 inches of rain since midnight. McGregor Executive Airport’s gauge reports receiving 1.87 inches.

Wet, but no major damage in McLennan County

From Trib staffer Erin Quinn:

Steve Vaughn, McLennan County’s assistant emergency coordinator, said he is surprised this morning to report no major damage because of overnight storms.

“We’re seeing lots of water on roads,” he said, but added that none, so far, have been deemed impassable.

“I think Bell County really took the brunt of this one,” he said.

Area received 3-4 inches of rain

From Trib staffer Erin Quinn:

Gary Woodall, a meteorologist with the National Weather Service is reporting up to 4 inches of rainfall over McLennan County and its surrounding areas. That will likely lead to flooded areas and roadways that should not be driven over if water is across the road.

Bosque, Mills, Navarro and Hill counties, he said, received the heaviest rainfall overnight at 3-4 inches.

McLennan County saw more widespread rainfall, he said, with the northwest and southeast corners of the county seeing the most.

Woodall said he is not seeing much damage from hail, but the Salado and Belton areas have seen damage from high winds.

Bell County reports most damage

From Trib staffer Erin Quinn:

The most damage in Central Texas has been reported in Bell County.

Trees and power lines are down in Salado, and a Bells County dispatcher reported that they’re seeing barns “just go poof.”

In the Mills Creek/Salado area roofs have been torn off, and Pace Park Road is closed because a tree is lying across it.

“It’s just so much water so quickly,” the dispatcher said.

Falls County officials are reporting a radio tower in Westphalia was snapped in half by high winds.

They are also getting reports of trees downed. No roads are closed, officials said.

The storm largely skipped the area, though it appeared headed directly for Falls County.
